ĢƵ New Talent - FRESH – rules & regulations

Rules and Regulations for ĢƵ New Talent search for new documentary making talent with ĢƵ THREE known as FRESH

1. Fresh is a search for new documentary talent(“the Campaign”)which is organised by the British Broadcasting Corporation (“the ĢƵ”).

2. In consideration of the ĢƵ agreeing to assess entries to the Campaign each Entrant by entering licenses the ĢƵ for itself and those authorised by it the exclusive right to use an entry for communication to the public (which includes broadcasting and internet use) and all other rights for the purposes of the Campaign only. This licence shall subsist until the Entrant is unsuccessful, or in the case of successful entries until either the end of the Campaign (31/08/08) or until the conclusion of any good faith continuing discussions with the ĢƵ concerning future use of the entry if later.

3. Entrants consent to being filmed and recorded by the ĢƵ where required for the Campaign and for films or recordings made pursuant to this rule being used for all purposes of the Campaign.

4. The ĢƵ reserves the right to refuse any entry for any reason at its absolute discretion.

5. The decisions of the judges are final. Neither correspondence nor discussion concerning any decision shall be entered into.

6. Entrants must submit only their own original work and agree that this will not infringe the copyright or any other rights of any third party. Entrants agree to indemnify the ĢƵ in respect of any costs claims damages or liabilities arising out of any breach of this clause.

7. The Entrant must be the sole author of the entry.

8. Entrants may each submit only one entry. They should complete the entry form and provide a cv. The ĢƵ may contact companies or individuals named on the cv in the course of its selection process.

9. Entrants permit the ĢƵ to edit or change entries in any way it may in its sole discretion consider necessary for the purposes of use in the Campaign.

10. Entrants, by entering, waive in favour of the ĢƵ and those authorised by it any so-called “moral rights” they may have in relation to an entry which waiver shall subsist either for the period of the Campaign or until the entrant is unsuccessful (if sooner).

11. The description of the awards prizes and selection process in any Campaign literature or other medium is not binding and may be varied by the ĢƵ and the ĢƵ may make additional awards or prizes but it shall not be obliged to make any award or prize if it considers it inappropriate to do so or if entries do not reach the required standard.

12. Entrants must be 18 years of age or over at the time of the closing date. ĢƵ staff members, their close relations and entrants who have previously directed a 60 minute documentary for network television are ineligible.

13. Entries will be judged on the following criteria:-
a) How well the entrant has demonstrated an understanding of what would appeal to a ĢƵ Three audience
b) the originality of the idea submitted and the quality,style and creativity of the narrative content and central theme.
c) the stage of development of the idea and the demonstration of how it can be realised
d) The relevance of the Entrant's experience and evidence that the entrant has the talent to develop and direct a one hour documentary

14. Attendance by Entrants at any event staged by the ĢƵ for the purposes of the Campaign and travel to and from any such event is also at the Entrant’s own risk and the ĢƵ accepts no responsibility or liability in this regard.

15. The ĢƵ reserves the right to seek and issue publicity on behalf of Entrants.

16. Acceptance of these rules is a condition of entry.

17. The ĢƵ shall not be obliged to make use of any entry and shall not be liable for any loss of publicity or enhancement of reputation.

18. Entries are made at an Entrant’s own expense and the ĢƵ shall not be liable to reimburse any expenses incurred in making an entry.

19. Entries must not contain defamatory or obscene material.

20. Entrants selected for the second stage or subsequent stages of the Campaign may be asked to undertake not to accept any engagements of the kind being assessed by the Campaign for any United Kingdom broadcaster other than the ĢƵ prior to the end of the Campaign without having first entered into good faith discussions with the ĢƵ.

21. The ĢƵ will endeavour to contact all entrants to let them know whether or not they have been selected to progress to the next stage. It cannot however accept any responsibility for any failure to make such contact.

22. All Entrants must be resident in the United Kingdom. Entrants must be eligible to work in the United Kingdom.

23. In the event that the ĢƵ wishes to use an Entrant’s contributions for broadcast the Entrant will be offered the ĢƵ’s standard contract and terms appropriate to such contribution.

24. The ideas submitted will be used only in connection with assessment of entries and such material shall only be made available to those directly responsible for assessment of entries or the management of particular Events. Unless otherwise stated the ĢƵ shall not use such material for purposes other than those specified in these Rules without the prior agreement of the Entrant.

25. All entries will be read by a ĢƵ Commissioning Executive and a producer who will prepare a shortlist of up to 20 semi-finalists. The semi -finalists will attend a one day masterclass planned to be held in January 2008 in London where they will have a chance to pitch to panels of experienced executives. The panels will select up to 6 finalists.

26. Following the masterclass up to 6 finalists will be selected for detailed interviews in London. Following those interviews up to 3 entrants may be commissioned to turn their idea into a documentary which will have to be made to a specified budget.

27. If any selected entrant is unable to attend the master class or interviews or is unable to be contacted the ĢƵ reserves the right to substitute a runner up.

28. Entries must include a completed entry form, a CV and a documentary idea no longer than one page of A4. They should be posted to Room 7003, ĢƵ TVC, London W12 7RJ or emailed to talent@bbc.co.uk by December 16th 2007. Entries cannot be returned.
